SOAR Care Terms of Use

Version: Live version 1 · Authorised for publication · Last updated: 1 November 2026

These Terms govern use of SOAR Care, operated by This Is Legacy Ltd in Auckland, New Zealand ("SOAR Care", "we", "us", "our"). By creating an account or using SOAR Care, you agree to these Terms.

1. What SOAR Care is

SOAR Care is a digital organisation and information-sharing tool designed to help families, whānau, caregivers and authorised support people coordinate care information. It may include Care Profiles, medications, appointments, tasks, notes, care plans, respite information, documents, emergency information, Care Circle sharing, messaging, wellbeing information, goals and related features.

SOAR Care is a coordination tool. It is not a medical provider, emergency service, legal adviser, financial adviser, government agency, clinical record system, or substitute for professional advice.

The SOAR Care Caregiver Programme (in-person sessions) is optional. You do not need to take part in it to use SOAR Care. If you enter a programme code, it only records which programme group you came from; it does not control your access.

2. Eligibility and authority

Anyone with a verified email address can create a SOAR Care account. You must provide accurate account information and keep your account secure. Before using SOAR Care, you must accept the current Terms of Use, Privacy Policy and Privacy Notice.

You must only enter, upload, manage or share another person's personal or health information where you have a lawful basis and appropriate authority to do so. This may arise because the person has authorised you, you are legally entitled to act for them, or another lawful basis applies.

You are responsible for determining whether you have authority to create or manage a Care Profile for another person.

Every Care Profile must be approved by a SOAR Care founder before it can be used for care coordination, including sharing, invitations, appointments, identifiers and the Emergency QR. The founder reviews the person's name and date of birth, the owner's answers about their authority and relationship to the person, and any authority evidence uploaded. That review is an additional safeguard: it does not create legal authority, replace the person's consent where required, or make a family or caregiving relationship alone sufficient. If authority or the person's wishes are unclear, disputed or insufficient, SOAR Care will not approve the profile.

Each Care Profile requires the person's National Health Index (NHI) number, and only one active Care Profile can exist for each NHI number across SOAR Care. If a Care Profile cannot be created, you will be asked to contact SOAR Care so we can help.

3. Information entered by users

Users control the information they choose to enter into SOAR Care. You are responsible for ensuring information you enter is accurate, current, lawful and appropriate.

SOAR Care does not independently verify user-entered medical, medication, appointment, contact, legal, emergency or care information. Information displayed by SOAR Care should be checked against authoritative sources where decisions may affect a person's health, safety, legal rights or wellbeing.

4. Care Circle invitations, permissions and sharing

SOAR Care may allow account owners or authorised users to invite other people and assign access permissions.

You are responsible for deciding whom you invite and what access you grant. Before sharing access, you should confirm the recipient's identity, relationship to the person receiving care, and genuine need for the information.

SOAR Care provides technical controls for sharing but cannot control:

  • whom a user chooses to invite
  • whether the user has authority to share particular information
  • what an authorised recipient does with information after legitimately accessing it
  • information a recipient copies, downloads, photographs, prints, exports or communicates outside SOAR Care
  • disclosure caused by a user sharing credentials or failing to secure their own device or account.

This does not remove SOAR Care's responsibility for privacy or security matters that the law places on us, including protecting information within systems under our control.

Access should be removed promptly when a person no longer requires it.

5. Medical and emergency use

Do not rely on SOAR Care as the sole source of information for urgent medical decisions. In an emergency, contact the appropriate emergency service or qualified health professional.

Users and health professionals should independently verify critical information such as medicines, doses, allergies, diagnoses and emergency instructions before relying on it.

6. Account security

You must use your own account, keep credentials confidential, protect devices used to access SOAR Care, and notify us promptly if you suspect unauthorised access. We recommend turning on multi-factor authentication for your account.

You must not attempt to access another person's account or data without permission, bypass security controls, scrape or attack the service, introduce malicious software, or use SOAR Care unlawfully.

7. Availability and changes

We aim to provide a reliable service but cannot promise uninterrupted or error-free availability. Maintenance, outages, third-party service failures, security events and circumstances outside our reasonable control may affect access.

We may update features where reasonably necessary for security, functionality, compliance or service improvement. Material changes affecting users will be communicated where appropriate.

If we materially change these Terms, the Privacy Policy or the Privacy Notice, we will ask you to accept the new versions before you continue to use SOAR Care.

8. Intellectual property

SOAR Care software, branding, designs and original content belong to This Is Legacy Ltd or its licensors. Users retain rights in content they lawfully upload or create.

You give us the limited permission necessary to host, process, display, transmit and back up your content solely to provide, secure and operate SOAR Care and for other purposes described in the Privacy Policy.

9. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect users, comply with law, investigate misuse, address security risks, or enforce these Terms. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.

10. Liability

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under New Zealand law.

To the maximum extent permitted by law, SOAR Care is not responsible for loss caused by:

  • inaccurate, incomplete or outdated information entered by users
  • a user granting access to the wrong person or granting permissions beyond that person's needs
  • actions taken by another user or authorised recipient outside SOAR Care's reasonable control
  • reliance on SOAR Care instead of appropriate medical, emergency, legal or other professional advice
  • a user failing to secure their account, credentials or device
  • third-party services or events outside our reasonable control, except to the extent the law makes us responsible.

Any limitation of liability applies only to the extent permitted by applicable law and does not excuse SOAR Care from duties that cannot lawfully be excluded.

11. Consumer rights

These Terms do not remove any rights you have under applicable New Zealand consumer, privacy or other law.

12. Privacy

Our Privacy Policy explains how we collect, use, store, disclose, protect and retain personal information.

13. Governing law

These Terms are governed by New Zealand law. Any dispute will be dealt with under applicable New Zealand law and by courts or dispute-resolution bodies with lawful jurisdiction.
